On August 27, 2026, the U.S. Department of Justice (DOJ) sued the State of Arizona to block state laws that allow certain students, regardless of immigration status, to qualify for in-state tuition and state-funded financial assistance at Arizona public colleges and universities. The lawsuit challenges provisions adopted through Proposition 308, which Arizona voters approved in 2022. Proposition 308 allows students who attended an Arizona high school or homeschool for at least two years and graduated or obtained an equivalent credential in the state to qualify for in-state tuition regardless of immigration status. DOJ claims Arizona’s policy is violating federal law and discriminating against U.S. citizens who reside outside the state by providing benefits to undocumented students while denying them to out-of-state U.S. citizens.
