On August 27, 2026, the U.S. Department of Justice (DOJ) sued the State of Oregon to block state laws that provide qualifying undocumented students with in-state tuition and access to state-funded scholarships and financial aid. The lawsuit principally challenges Oregon’s 2013 Tuition Equity Act, which allows certain students who attended and graduated from Oregon schools to receive resident tuition at the state’s public universities regardless of immigration status. DOJ claims Oregon’s policy is violating federal law and discriminating against U.S. citizens who reside outside the state by providing benefits to undocumented students while denying them to out-of-state U.S. citizens.
