United States v. California Air Resources Board

On March 12, 2026, the U.S. Department of Transportation filed a lawsuit against the California Air Resources Board to stop enforcement of the state’s carbon dioxide emissions standards, arguing these more stringent standards impose illegal, state-specific mileage requirements for automakers. While federal legislation overturned the 2035 ban on new gasoline-powered vehicles under Advanced Clean Cars II in 2025, this new lawsuit takes aim at the earlier Advanced Clean Cars I framework, which was approved by the EPA in 2022. The lawsuit aims to stop California from enforcing these stricter standards, which seek to reduce emissions that pose climate and public health risks. Currently 17 other states representing over one-third of the U.S. automobile market also follow these emissions standards.
