The California Department of Justice released its legal opinion on daily fantasy sports. As required by Government Code section 12519, the Department must release formal legal opinions on qualifying issues when requested by a member of the legislature. This opinion was requested by Assemblymember Tom Lackey. In issuing this legal opinion, the Department was tasked with describing existing law. The Department doesn’t have the authority to make new law or change the law – only the Legislature and the voters of California can decide whether to change the law.
