The New Mexico Department of Justice has reversed the issuance of liens on nearly 200 residential properties in Albuquerque after a local subcontractor, Boreworxx Construction, LLC, filed the illegal liens in an attempt to frighten and manipulate homeowners. Following the NMDOJ’s investigation, Boreworxx operator Jeffery Dailey has released the liens and is prohibited from future misconduct.

The NMDOJ’s investigation revealed that the liens were part of a scare tactic aimed at coercing homeowners to complain in an effort to get Boreworxx paid for fiber optic installation work that allegedly was not competed satisfactorily. Boreworxx Construction, LLC was contracted by Circet USA to complete work on a project that aims to improve internet services in the City of Albuquerque in city-owned rights of way. Upon discovery of work alleged to be performed unsatisfactorily, Circet USA refused to pay the contract balance prompting Boreworxx to issue the illegal liens.

“We will not tolerate abusive scare tactics or unethical behavior by businesses in this community. Prompt reporting of this issue by both members of the community and the City of Albuquerque, enabled our office to take action and stop this company from holding homeowners hostage and using them as a bargaining chip in their ongoing contract dispute.” – AG Torrez
