AG Bonta co-led a bipartisan coalition of 45 attorneys general in submitting a comment letter supporting a proposed U.S. Department of Labor (Department) rule that would require greater transparency from pharmacy benefit managers (PBMs) that service employer-funded health plans covered under the Employee Retirement Income Security Act of 1974 (ERISA).
“PBMs have significant control over prescription drug pricing and coverage decisions, yet too often operate without transparency or accountability. This proposed rule is an important step toward greater transparency in how PBMs operate across the country. In addition, my fellow attorneys general and I call on the Department of Labor to ensure that any final rule fully respects and preserves the ability of states to enforce their own laws designed to protect consumers from unfair and abusive PBM practices.” – AG Bonta
